Welcome to Dopamap, a mobile application operated by Eldopas LLC. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO COMPLY WITH AND BE BOUND BY THESE TERMS AND CONDITIONS, AS WELL AS OUR PRIVACY POLICY, COMMUNITY GUIDELINES, AND BRAND GUIDELINES. These Terms govern your use of our Services, including any content, functionality, and Services offered on or through Dopamap. Eldopas LLC reserves the right to modify these Terms at any time. Continued use of the Services following any such changes constitutes your acceptance of the new Terms. The words "Dopamap" and "Eldopas LLC" may be used interchangeably throughout these tTerms and Conditions and in other documents (such as the Privacy Policy, Community Guidelines, Brand Guidelines, and Cookie Policy) referenced in these terms. All the terms are applicable to both Dopamap and Eldopas LLC.

Dopamap provides a platform for users to connect and interact seamlessly. You can post events, activities, research studies, rideshare options, and housing listings on our immersive-view map, allowing you to discover and engage with local and community-based opportunities easily. Our flash date feature allows you to experience spontaneous, quick, and fun meet-ups. We continuously strive to enhance your experience and improve functionality, actively working to prevent misuse and harmful conduct within our community. We take swift action, including the removal of abusive content or individuals, and cooperate with law enforcement when necessary.

You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. It is important to read all the Terms and Conditions of our Services before creating an account and to agree to follow them while using your account to access our Services. We reserve the right to update these Terms and Conditions at any time. The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

You must be at least the minimum age as required by law in your country, state, or territory to register for and use our Services without parental approval. If you are located in the United States, you must be at least the legal age of 16 to 18 years, depending on the state in which you reside, to use our Services. If we learn that personal information from users less than the stated age limits has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

To use our Services, you need to provide certain devices, software, and data connections, which we do not supply. By using our Services, you consent to manually or automatically download and install updates to our Services. You also agree to receive notifications from us, as necessary, through our Services to ensure their proper functioning and to keep you informed about updates and other essential information. You are responsible for any carrier data plans, Internet fees, and other associated fees and taxes related to your use of our Services. Please ensure that you are aware of these costs before using our Services to avoid unexpected charges.

By using our Services, you agree to our Dispute Resolution provisions. These include a mandatory pre-arbitration informal dispute resolution process (except for certain claims of serious misconduct), an arbitration agreement, and waivers of class actions and jury trials. THE BINDING ARBITRATION PROVISION IN OUR TERMS STATES THAT DOPAMAP, OPERATED BY ELDOPAS LLC, AND YOU AGREE TO RESOLVE ALL DISPUTES THROUGH ARBITRATION. YOU WAIVE YOUR RIGHT TO HAVE DISPUTES RESOLVED OR JUDGED BY A JUDGE OR JURY TRIAL, AND TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS. Arbitration typically involves less discovery and appellate review than court proceedings.

Privacy Policy

Since our services are hosted in the U.S., using Dopamap from other regions means you consent to your data being processed in the U.S. We may update the Privacy Policy anytime and will notify you of changes on the app.

By using the Services, you consent to the collection, use, and disclosure of your information, and you agree to be bound by our Privacy Policy. Please note that the Services are hosted in the United States. If you access Dopamap from any other region with laws or requirements governing personal data collection, use, or disclosure that differ from U.S. laws, you are transferring your data to the United States and expressly consent to its processing here. Eldopas LLC reserves the right to update the Privacy Policy at any time, and we will notify you of any changes by posting the updated Privacy Policy on Dopamap.

These guidelines are designed to promote respectful interactions and prevent abuse, harassment, and other inappropriate behavior. Violation of these guidelines may result in the suspension or termination of your account.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We recommend using a strong password and changing it regularly. If you suspect any unauthorized access to your account, please notify us immediately at supportdopamap@eldopas.com.

Data Handling

By using our app, you agree to this practice, even if U.S. data protection laws differ from your local laws. We ensure your data is safe according to Google Firebase's security terms. Using our services means you consent to this data handling.

We process and store all your personal data in the United States, where our servers are located. By using the Services, you consent to the processing and storage of your data in the United States, which may have different data protection rules than your local law. We take steps to ensure your data is safe and secure in accordance with Google Firebase's data processing terms (https://firebase.google.com/terms/data-processing-terms#7.-data-security). Your use of the Services indicates your acknowledgment and consent to this practice, which is necessary for us to provide our Services.

Acceptable Use of Our Services

You are responsible for keeping your device and Dopamap account safe and secure. Please notify us at supportdopamap@eldopas.com promptly of any unauthorized use or security breaches related to your account or our Services.

You must access and use our Services only for lawful, authorized, and acceptable purposes. You must not, and must not assist others to, in any way—whether directly or indirectly, and through any means—access, use, modify, replicate, create derivative works from, distribute, license, sublicense, transfer, display, perform, or otherwise exploit our Services in any unauthorized or harmful manner. This includes any actions that could cause harm to Dopamap, its users, our Services, our systems, any third parties, or others. You agree not to use, or assist others in using, our Services in ways that:

Violate or infringe upon the rights of Dopamap, other users, or any third parties, including privacy, intellectual property, proprietary rights or any applicable law or regulation.
Engage in illegal, fraudulent, deceiving, obscene, defamatory, pornographic, threatening, harassing, hateful, racially/ethnically offensive conduct, or promote violence or harm.
Contains personal information of others, including addresses, phone numbers, and payment information.
Infringes on the intellectual property rights, privacy rights, or other legal rights of any person or entity.
Contains unsolicited promotions, advertisements, or political campaigns.
Publish false or misleading statements, or misrepresent your identity, age, or affiliations.
Send spam, bulk messaging, auto-messaging, auto-dialing, or other impermissible communications.
Impersonate others or collect users' information without authorization.
Reverse engineer, alter, or create derivative works from our Services or their content.
Send, store, or transmit viruses or other harmful code.
Gain or attempt to gain unauthorized access to our Services or systems.
Disrupt the safety, security, or performance of our Services, or interfere with other users' experiences.
Create accounts using unauthorized or automated methods.
Use the Services for non-personal purposes without explicit permission.
Misuse any reporting channels by submitting false or groundless reports.
Solicit personal or financial information from users for commercial or unlawful purposes.
Use another user's account, or solicit money or items of value as gifts, loans, or compensation.
Use our Services for fraudulent activities, political campaign financing, or to influence elections.
Disclose proprietary information you do not have the right to disclose.
Use automated devices or processes to access or scrape our Services.
Upload viruses or malicious code, or compromise the security of our Services.
Create new accounts after suspension or termination without permission.
Submit false reports about another user's behavior or content.
Develop third-party applications that interact with our Services or content without consent.
Probe, scan, or test the vulnerability of our Services or systems.
Encourage or engage in activities that violate our Terms and Conditions.

Who Can Use the Services

You must be at least the minimum age as required by law in your country, state, or territory to register for and use our Services without parental approval. If you are not old enough to have the legal authority to agree to our Terms in your country or territory, your parent or guardian must agree to our Terms on your behalf. Please have your parent or guardian read these Terms with you to ensure you understand them. If we learn that personal information from users less than the stated age limits has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. By using the Services, you represent, warrant, and agree that you will comply with these Terms, including any other terms and policies referenced in these Terms, (such as Community Guidelines and Privacy Policy) and all applicable local, state, national, and international laws, rules, and regulations.

User Content

User Content and License: Dopamap allows users to create, post, store, and share a variety of content, including but not limited to text, images, videos, logos, and other materials (collectively, "User Content"). As the owner of your User Content, you retain all rights to it. However, by posting User Content on Dopamap, you grant us a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your content in any media formats and channels, now known or later developed, without compensation to you.

Visibility and Sharing: When you post your content on Dopamap, you understand that it may be visible to others, including your username and profile photo.

Responsibility and Monitoring: Dopamap is not obligated to actively monitor User Content and does not endorse any User Content. We may, however, review and remove any User Content that we deem inappropriate or that violates these guidelines, without notice and at our discretion. By posting on Dopamap, you acknowledge that we have the right to remove content and take action against users who violate these guidelines.

Legal Compliance and Accountability: By posting User Content, you represent and warrant that your content complies with all applicable laws and that you have the right to grant Dopamap the license outlined above. You are responsible for any legal issues or damages resulting from your User Content. Dopamap reserves the right to remove content that violates these guidelines or that may expose us or our users to legal liability.

Electronic Communications, Transactions, and Signatures

By using our Services, you consent to receive electronic communications from us, including agreements, notices, disclosures, and other communications, which satisfy any legal requirement for written communication. You agree that electronic signatures used on our platform are legally equivalent to handwritten signatures. By interacting with our Services through visits, emails, and online forms, you accept electronic communication and delivery of documents. You also waive any legal requirements for original signatures or non-electronic records in any jurisdiction.

Prohibited Activities

You are granted access to our Services for specified purposes only, and any other usage is strictly prohibited. The Services must not be utilized for commercial activities unless explicitly authorized by us.

As a user of Dopamap's Services, you agree not to engage in the following activities:

Jeopardizing Service Integrity: Do not, by yourself or with others, seek to undermine or compromise the functionality or security of our Services. This includes security breaches, unauthorized tests, and use of automation tools.
Data Misuse: Refrain from systematically retrieving data or content from our Services to create a collection, database, or directory without our explicit permission.
Deception and Fraud: Avoid deceiving or misleading us or other users, particularly in attempts to access sensitive information such as passwords.
Security Interference: Do not circumvent or interfere with security features, including those that restrict use or copying of content.
Harmful Conduct: Do not engage in any behavior that disparages, tarnishes, or harms Dopamap, its users, or its Services.
Harassment and Abuse: Using information from our Services to harass, abuse, or harm others is prohibited. Avoid making false reports or misusing support Services.
Legal Compliance: Use the Services in accordance with all applicable laws and regulations. Unauthorized framing or linking to our Services is not allowed.
Malware and Disruption: Do not upload or transmit viruses, Trojan horses, or other harmful materials, or engage in excessive spamming that disrupts the Services.
Automated Usage: Avoid using automated systems, scripts, bots, or data mining tools to interact with our Services.
Impersonation: Do not impersonate another user or person, or misuse another user's username.
Privacy Invasion: Do not upload or transmit material that collects information without consent, such as spyware or tracking pixels.
Service Interference: Avoid actions that disrupt the Services or create an undue burden on our network and Services.
Harassment of Staff: Do not harass, annoy, or threaten our employees or agents providing any part of the Services.
Circumvention: Do not attempt to bypass access restrictions to the Services.
Unauthorized Software Use: Do not copy, adapt, or reverse-engineer any part of the Services' software.
Competing Usage: Do not use the Services for activities that compete with us or for unauthorized commercial endeavors.
Unauthorized Transactions: Do not sell or transfer your profile, and avoid using the Services for unauthorized purchases or transactions.

Content Moderation
Please note that most content on our platform is owned or controlled by users or third-party, and Dopamap does not assume control or responsibility for such content. This includes posts made publicly as well as messages sent privately. Users are solely responsible for the content they create and share. While we retain the right to review, moderate, or remove any content on our Services, we do not and cannot review all content. Therefore, we cannot guarantee that all content or user interactions will comply with our Terms and Conditions, Community Guidelines, or other policies. Users can report content or accounts for violating our guidelines. If you have concerns or complaints about content decisions, you may submit a complaint at supportdopamap@eldopas.com. Complaints must be submitted within six months of the relevant decision. Upon receiving a complaint, Dopamap will:

Review the complaint in a timely, fair, and thorough manner.
Reverse our decision if we find that our initial assessment was incorrect.
Promptly inform you of our decision and any available options for further recourse.

Third-Party Services and Content

Summary: Using third-party materials through Dopamap means you accept their terms. We do not endorse third-party content and are not liable for their actions or terms. Links to third-party sites are for convenience and do not imply endorsement.

By using our Services, you acknowledge that Dopamap is not responsible for examining or evaluating the content, accuracy, completeness, legality, reliability, or quality of any third-party materials or third-party Services. Certain features or Services on Dopamap may include, display, or provide access to content, data, information, applications, or other materials from third parties. We may also provide links to third-party websites or permit the use of third-party Services in connection with Dopamap. When you use any third-party materials or Services made available through or in connection with Dopamap, including those offered jointly with third parties, you acknowledge and agree that the third party's Terms and Conditions will govern your relationship with that third party. Dopamap is not responsible or liable for any third party's terms or actions taken under those terms. We do not endorse or warrant, and we will not have any liability or responsibility for any third-party content, Services, websites, or any other materials or Services of third parties.

The inclusion of third-party materials, Services, or links to third-party websites is provided solely for your convenience and does not imply endorsement by Dopamap. We encourage you to review the applicable Terms and Conditions of any third-party Services or materials you use and to conduct any necessary due diligence before engaging with them.

For apps and Services downloaded from third-party stores, you agree that:

These terms are concluded solely between you and Dopamap, and not with the third-party store providers. Dopamap is solely responsible for the app and its content.
The third-party store providers have no obligation to provide maintenance or support Services for the app. Any warranties or responsibilities for the app lie solely with Dopamap.
Dopamap is responsible for addressing any claims related to the app or your use of it, including product liability claims, compliance with legal requirements, consumer protection claims, and intellectual property infringement claims.
The third-party store providers and their subsidiaries are third-party beneficiaries of these terms, with the right to enforce these terms against you.

In case of any conflict between the terms of the third-party store or your mobile carrier and these terms, the terms of the third-party store or mobile carrier shall govern. Dopamap is not responsible for third-party goods or Services you obtain through these platforms. We recommend conducting your own investigation before proceeding with any transaction with third parties.

Mobile Charges and Messaging

Summary: You are responsible for any fees from your mobile service provider, including data and messaging charges. By providing your mobile number, you agree to receive service-related messages, even if your number is on a Do Not Call list. Keep your account updated to avoid messages intended for you being sent to someone else.

When you use Dopamap's Services, you are responsible for any charges incurred from your mobile service provider. This includes data usage fees and charges for sending or receiving messages such as SMS, MMS, or other messaging protocols or technologies. By providing your mobile phone number to Dopamap, you consent to receive messages related to our Services. You may receive these messages even if your mobile number is registered on any state or federal Do Not Call list, or an international equivalent. Make sure to update your account information if you change or deactivate the mobile number. This is to prevent us from sending messages intended for you to another person.

Intellectual Property

Summary: Dopamap owns all intellectual property rights related to our Services, including content and trademarks. You may use them for personal or internal business purposes only. Any misuse or infringement may lead to termination of your rights and legal consequences. Feedback or submissions become our property, and you must follow our guidelines for using Dopamap's branding to avoid unauthorized use or legal actions.

We, Dopamap, are the sole owner or licensee of all intellectual property rights related to our Services. This includes, but is not limited to, source code, databases, functionality, software, app and website designs, audio, video, text, photographs, and graphics (collectively, the "Content"), as well as Service marks, trademarks, and logos ("Marks"), whether they are registered or unregistered. Our Content and Marks are protected by copyright and trademark laws, along with other intellectual property rights and unfair competition laws both in the United States and globally. The Content and Marks are provided "AS IS" for your personal, non-commercial use or for internal business purposes only.

We retain all rights not expressly granted to you in these terms regarding the Services, Content, and Marks. Any breach of our intellectual property rights will result in immediate termination of your right to use our Services and may lead to legal action. YOU ARE SOLELY RESPONSIBLE FOR YOUR SUBMISSIONS AND/OR CONTRIBUTIONS AND YOU EXPRESSLY AGREE TO REIMBURSE US FOR ANY AND ALL LOSSES THAT WE MAY SUFFER BECAUSE OF YOUR BREACH OF (A) THIS SECTION, (B) ANY THIRD PARTY’S INTELLECTUAL PROPERTY RIGHTS, OR (C) APPLICABLE LAW.

Ownership and Use of Submissions: By providing us with any feedback, suggestions, ideas, or other submissions (collectively, “Submissions”), you acknowledge that they are non-confidential and automatically become the sole property of Dopamap, along with all related intellectual property rights. Dopamap has the unrestricted right to use, modify, and distribute these Submissions for any purpose, without any obligation to acknowledge or compensate you.

You agree to follow Dopamap’s Brand Guidelines, which may be updated periodically, and to cease any use that we determine to be nonconforming or unacceptable immediately. You are not permitted to create or use any materials, either physical or digital, that incorporate the Dopamap Marks without our prior written approval. Any unauthorized creation or use of materials featuring the Dopamap Marks will be considered property of Dopamap, and you agree to assign all related rights, titles, and interests to Dopamap.

Compliance and Enforcement: We respect the intellectual property rights of others and expect our users to do the same. If you believe any content on the Dopamap Platform infringes your intellectual property rights, please refer to our Copyright and Infringement section for instructions on how to file a complaint.

Violation of any part of this section may result in immediate termination of your license to use the Dopamap Marks, and Dopamap may take necessary legal action to enforce its rights, which could include takedown requests or legal proceedings.

Mobile Application License

Summary: When you download Dopamap, you receive a limited license to use it on your personal Apple or Android devices, subject to specific terms. You must not modify the app, use it for commercial purposes not intended by us, or violate any laws. Each App Distributor (like Apple or Google) has its own rules you must follow when using Dopamap from their stores.

License Grant

By downloading or using the Dopamap app, we grant you a revocable, non-exclusive, non-transferable, limited license to install and use the App on your personal wireless electronic devices that have a proper identifiable MAC address attached to a legitimate manufacturer-made device. You should not use Dopamap on any unauthorized (made-up) devices such as Raspberry Pi’s, emulators, etc. This license allows you to access and use the App strictly in accordance with these Terms and Conditions.

You agree that you will not:

Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App, except as permitted by applicable law.
Make any modification, adaptation, improvement, enhancement, translation, or derivative work from the App.
Use the App in violation of any applicable laws, regulations, or rules.
Remove, alter, or obscure any proprietary notice, including copyright or trademark notices, provided by us or our licensors.
Use the App for any revenue-generating endeavor or commercial enterprise, or for purposes for which it is not designed.
Make the App available over a network or environment that allows access by multiple devices or users at the same time.
Use the App to create a product, Service, or software that competes with the App or is a substitute for it.
Use the App to send automated queries or unsolicited commercial emails.
Use our proprietary information or interfaces in the design, development, manufacture, licensing, or distribution of applications, accessories, or devices for use with the App.

Apple and Android Devices

The following terms apply when you download the App from either the Apple App Store or Google Play Store (each an "App Distributor"):

License Scope: The license to use the App is non-transferable and limited to the use of the App on devices running Apple iOS or Android, as per the App Distributor’s usage rules.

Maintenance and Support: The App Distributor has no obligation to furnish any maintenance or support Services. We will be the only ones providing any maintenance and support for the Services provided within the App.

Compliance with Laws: You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country by the U.S. government, and that you are not listed on any U.S. government list of prohibited or restricted parties.

Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App, such as wireless data Service agreements when using the App.

Guidelines for Review

Summary: When leaving reviews on Dopamap, ensure they're based on firsthand experience, use respectful language without discrimination or illegal references, and avoid biased reviews if affiliated with competitors. Dopamap reserves the right to moderate reviews and holds no liability for the user’s review. By posting a review, you grant Dopamap the right to use it across our platform.

We provide you with the opportunity to leave reviews or ratings on our Services. When posting a review on Dopamap, you must adhere to the following criteria:

Firsthand Experience: You must have direct, firsthand experience with the event, entity, or person you are reviewing.
Respectful Language: Your reviews must not contain offensive language, including profanity, abusive comments, or any form of hate speech.
Non-Discriminatory: Reviews must not include discriminatory remarks based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.
Legal Compliance: Reviews must not reference or endorse illegal activities.
Competitor Bias: If you are affiliated with a competitor (including but not limited to being an employee, contractor, shareholder, partner, or having any other business or personal relationship), you are not permitted to post negative reviews.
Legal Assertions: You may not make any judgments about the legality of conduct in your reviews.
Accuracy: Reviews must be truthful and not contain false or misleading statements.
Campaigns: You are not allowed to organize or encourage campaigns to post reviews, whether positive or negative.

Review Moderation

Discretionary Action: We may accept, reject, or remove reviews at our sole discretion. We are not obligated to screen reviews or to delete reviews, even if they are considered objectionable or inaccurate by others.
Non-Endorsement: Reviews do not represent the opinions or views of Dopamap, our affiliates, or our partners. They are solely the opinions of the individual reviewers.
No Liability: Dopamap assumes no liability for any review or for any claims, liabilities, or losses that may arise from any review.

Rights to Review Content

By posting a review on Dopamap, you grant us a perpetual, non-exclusive, worldwide, royalty-free, assignable, and sublicensable license to reproduce, modify, translate, display and distribute. This license allows us to use your review content in various ways, ensuring it can be shared and displayed across our platform as needed.

Copyright and Infringement

Summary: If you believe any content on Dopamap infringes your copyright, notify us by email at supportdopamap@eldopas.com with specific details, including where the infringing material is located. Your notice must include contact information, a statement confirming your ownership or authorization, and a declaration of accuracy under penalty of perjury. The venue for any legal proceedings related to these Terms or the Services is exclusively in the federal courts of the United States or the courts of the State of Indiana, situated in Fort Wayne. Additionally, disputes between users are to be resolved directly between the parties involved, with Dopamap assuming no responsibility for mediating such disputes or their outcomes.

Informal Negotiations
To expedite the resolution and control the costs of any dispute, controversy, or claim related to these Terms (each a "Dispute"), you and Dopamap (collectively, the "Parties") agree to first attempt to resolve any Dispute informally for at least thirty (30) days before initiating arbitration. Informal negotiations commence upon written notice from one Party to the other.

Agreement to Binding Arbitration
By using Dopamap, you and Dopamap mutually agree to waive your respective rights to resolve disputes in a court of law by a judge or jury and to settle any disputes through binding arbitration. This arbitration agreement ("Arbitration Agreement") is governed by the Federal Arbitration Act ("FAA"), or, if the FAA is inapplicable, by the laws of the State of Indiana. This agreement to arbitrate survives the termination of this Agreement or your relationship with Dopamap. Arbitration will be conducted on an individual basis, as class arbitrations and class actions are not allowed. This Arbitration Agreement applies to all claims between you and Dopamap, including its affiliates, subsidiaries, successors, assigns, and their respective officers, directors, employees, and agents. It also extends to claims involving Dopamap’s Service providers, such as background check providers and payment processors, which are intended third-party beneficiaries of this Arbitration Agreement.

Except as explicitly stated below, all disputes and claims between us shall be resolved exclusively by binding arbitration. This includes any disputes related to the terms of this Agreement, the use of Dopamap Services, your relationship with Dopamap, or any alleged violations, whether based on past, present, or future events. Claims covered include but are not limited to issues related to: the interpretation, enforcement, or validity of this Agreement; disputes over Services and promotions offered through Dopamap; claims under consumer protection laws, antitrust laws, and claims regarding unauthorized use, privacy invasion, fraud, or defamation. The arbitrator will have the authority to decide the scope, applicability, enforceability, and validity of this Arbitration Agreement.

By agreeing to arbitration, you and Dopamap understand that you are waiving the right to sue in court or to have a jury trial for all claims, except those explicitly excluded from arbitration under this Agreement. This Arbitration Agreement intends to cover every claim that can legally be arbitrated, except for those expressly excluded herein.

Scope of Arbitration Agreement
This Arbitration Agreement covers all disputes between you and Dopamap, including those involving our affiliates, subsidiaries, officers, and Service providers, relating to your use of the Dopamap Services. This encompasses claims arising out of or connected to the Dopamap Terms and Conditions, privacy rights, and any other disputes that may arise during your use of the Services. However, disputes regarding intellectual property rights or unauthorized use of Dopamap Services are excluded from arbitration and may be brought directly to court.

Arbitration Process
Before initiating arbitration, you must send a written Notice of Dispute to Dopamap, providing your name, address, user account details, a description of the dispute, and the relief sought. If Dopamap and you cannot resolve the dispute within 60 days, either party may initiate arbitration. The arbitration will be conducted under the rules of the American Arbitration Association (AAA), and presided over by a single arbitrator selected according to these rules. Arbitration fees, location, and procedural rules will be in accordance with the AAA guidelines, and any decisions on the scope or enforceability of the arbitration agreement will be made by a court.

Special Arbitration Provision

For Dopamap users in the United States or Canada, all disputes or claims related to the use of Dopamap Services must be resolved through binding individual arbitration. This Arbitration Agreement is governed by the Federal Arbitration Act (FAA), and where applicable, the laws of the State of Indiana. By agreeing to this provision, you waive your right to have disputes decided in court by a judge or jury, except for those related to intellectual property rights or those that can be resolved in small claims court. Arbitration is to be conducted solely on an individual basis, and class actions, class arbitrations, or any representative actions are prohibited.

Time Limit to Bring a Claim or Dispute

To ensure timely resolution, any claim or dispute, including initiating arbitration, must be brought within one year from when the dispute first arose. If you or Dopamap do not bring a claim within this one-year period, the claim will be permanently barred, meaning it cannot be pursued in arbitration or court. This time limit applies to the fullest extent permitted by law, and any claims filed beyond this period will be dismissed as untimely.

Prohibition of Class Actions and Non-Individualized Relief
You and Dopamap agree to bring claims in arbitration only on an individual basis, not as a class, collective, or representative action. This means that you and Dopamap waive the right to pursue or have disputes resolved as part of any class, collective, or representative proceeding. The arbitrator will have no authority to consider or resolve claims on a class, collective, or representative basis and can only grant relief to the individual party seeking it.

Notwithstanding other provisions in this Agreement, any dispute over the interpretation, applicability, or enforceability of this prohibition on class actions and non-individualized relief must be resolved by a court, not an arbitrator. If a court finds that the prohibition is unenforceable for any claim or remedy, that specific claim or remedy may be brought in a court, but the prohibition on class actions will still apply to all other claims or remedies to the fullest extent possible.

This section ensures that disputes related to your use of Dopamap Services will be handled efficiently and fairly, while also safeguarding the rights of both parties to pursue individual claims in a manner consistent with applicable law.

Restrictions
The Parties agree that arbitration is limited to the Dispute between the Parties individually. Arbitration will not be joined with any other proceeding. There is no right to arbitrate on a class-action basis or to utilize class action procedures. Disputes cannot be brought in a representative capacity on behalf of the general public or others.

Opt-Out and Small Claims Court
You may opt out of this arbitration agreement by sending a written notice to Dopamap within 30 days of accepting the terms or becoming subject to this arbitration provision. Opting out means you retain the right to have disputes resolved in court. Additionally, you may bring disputes in your local small claims court if the matter qualifies and is pursued on an individual basis.

User Disputes

Any disputes between you and other users must be resolved between the parties involved. We are not responsible for mediating such disputes and will not be liable for any issues arising from interactions between users.

Exclusive Venue/Forum Selection

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Indiana, in each case located in the City of Fort Wayne and County of Fort Wayne. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Choice of Law/Governing Law

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Indiana applicable to agreements made and to be entirely performed within the State of Indiana, without regard to its conflict of law principles.
